Why Lyft Accident Claims Are Different from Car Accident Claims

Lyft is the primary mode of transportation for many in the United States. The convenience it offers is matched by none, leading to a significant increase in rideshare users.

The problem is that since the rideshare industry boom, the US vehicular accidental death rate has increased by 3%. It may not seem like a lot, but it is 3% more people dying.

The victims of rideshare accidents can take action by filing a claim, which helps them recover from the losses and punishes the at-fault party. There are lots of differences between normal car accident claims and Lyft accident claims. But one common thing between these claims is insurance adjusters giving you a hard time.

The only way to combat the challenges that arise when dealing with Lyft accident claims is by hiring Lyft accident lawyers from Boohoff Law or other such great law firms.

These lawyers know what makes Lyft accident claims a headache and can deal with it.

What Makes Lyft Accident Claims Different

One may wonder what’s so different between rideshare accident claims and normal car accident claims. After all, you are going to get treated for your injuries, hire a lawyer and let them handle your claim. However, there are two key differences.

It is good to know about these differences. Having a little knowledge about a certain subject doesn’t hurt, right?

Liability

When a car accident happens, in most cases, one of the drivers is going to be held liable for the accident.

The addition of a rideshare company as a potential liable party increases the complexity of a case.

In some cases, the rideshare company can be held liable, and in some cases, it can’t. It all depends on the driver’s status.

See? It is already more confusing than normal car accidents.

Insurance Coverage

This is even more confusing than the liability part. Whose insurance policy is going to cover your losses?

This, again, depends on the driver’s status. If the driver is not logged in to the app, Lyft will not cover your losses. Instead, the driver’s insurance policy will cover your losses.

If the driver is on a ride, Lyft’s premium insurance will cover your losses. You will need the evidence to prove that the accident happened while the driver was on the ride. Remember, you are the plaintiff. You bear the burden of proof.

Make It Simple

Rideshare accident claims are complicated, but they don’t have to be. As Petyr Baelish says, “Knowledge is power.”

Knowing what to do after an accident can make a significant difference.

  • Medical Attention: Do not skip this step. Not getting medical attention can negatively impact your claim and your health. Get checked even if you feel fine.
  • Collect Evidence: Do this only if you didn’t sustain major injuries. Evidence like photos of the accident scene and information of the involved parties is all you need.
  • Police Report: Reporting the accident to police is absolutely mandatory if you intend to recover your losses.
  • Hire a Lawyer: You can file a claim on your own, but why risk it? Lawyers are there for a reason. Let them handle your case.

Final Thoughts

If you are a frequent user of rideshare services, the chances of you getting into an accident are high. Be smart and learn about the actions you need to take if you ever get into an accident. This knowledge can save you some day.
